Council of Europe Commissioner for Human Rights, Dunja Mijatović, released a comprehensive report today on her visit to Denmark in May-June 2023, highlighting both positive developments and pressing concerns regarding asylum policy and the rights of persons with disabilities.

While acknowledging positive strides, particularly in providing protection for individuals fleeing Ukraine and vulnerable women and girls from Afghanistan, Commissioner Mijatović expressed reservations about Denmark’s recent shift towards temporary protection and return policies, calling for a refocus on integration to mitigate human rights risks.

The Commissioner raised red flags regarding plans to externalize aspects of the asylum process to third countries, citing doubts about their compatibility with international human rights standards. She underscored the need for greater and fairer responsibility-sharing among European states and globally.

Of particular concern were measures intensifying efforts to ensure cooperation from rejected asylum seekers and undocumented migrants for return, leading to prolonged uncertainty and suspension of life for those unable to be returned, including families with children. The Commissioner urged reconsideration of the use of return centers and emphasized the prioritization of alternative measures to administrative detention.

Regarding integration, the Commissioner called for facilitating family reunification for protection holders and addressing the rising number of stateless persons. Additionally, she emphasized the need for structural improvements in the situation of persons with disabilities, advocating for reasonable accommodation and comprehensive action plans.

While recognizing progress in legal capacity and voting rights, the Commissioner urged a greater focus on supported decision-making and the abolition of full guardianship systems. She emphasized the importance of accessible citizenship acquisition procedures and the reduction of all forms of coercion.

As Denmark navigates its asylum and disability policies, the Commissioner’s recommendations aim to ensure the protection and integration of refugees and the rights of persons with disabilities, fostering a more inclusive and rights-respecting society.
